Terms and Conditions
Effective Date: September 2, 2026
These Terms and Conditions (“Terms”) govern your access to and use of the DJW Site Solutions website. By accessing or using this website, you acknowledge that you have read and agree to these Terms. If you do not agree, please discontinue use of the website.
About DJW Site Solutions
DJW Site Solutions is a veteran-owned excavation and site-work company serving residential and commercial customers throughout the Omaha metropolitan area and surrounding communities.
References to “DJW Site Solutions,” “we,” “us,” or “our” refer to DJW Site Solutions. References to “you” or “your” refer to any person accessing or using this website.
Website Purpose
This website provides general information about DJW Site Solutions, our capabilities, service areas, and methods for contacting us or requesting a quote.
Website content is provided for general informational and promotional purposes. It does not constitute engineering, surveying, legal, financial, environmental, or other professional advice.
Services and Availability
Services displayed on this website may include excavation, grading, land clearing, drainage improvements, driveway preparation, culvert work, preconstruction preparation, material placement, and related site work.
The availability and suitability of a service depend on factors including:
-
Project location and site access
-
Soil and ground conditions
-
Weather
-
Utility locations
-
Required permits and approvals
-
Equipment and material availability
-
Project size and scheduling
-
Environmental or property restrictions
We may accept, decline, postpone, or modify a proposed project at our discretion, subject to any signed agreement.
Quote Requests and Estimates
Submitting a contact form or quote request does not create a contractor-client relationship, guarantee service availability, reserve a project date, or obligate either party to proceed.
Any website pricing, examples, or general cost information is illustrative only. Actual pricing may vary based on the scope of work, site conditions, labor, materials, hauling, disposal fees, equipment requirements, permits, and other project-specific factors.
Unless expressly stated otherwise in writing, an estimate is not a final contract or guarantee of price. A project becomes authorized only after the customer and DJW Site Solutions accept the applicable written proposal or contract.
Project Agreements
Each accepted project may be governed by a separate written estimate, proposal, work authorization, or contract addressing matters such as:
-
Scope of work
-
Included and excluded services
-
Pricing and payment terms
-
Deposits
-
Materials
-
Scheduling
-
Change orders
-
Customer responsibilities
-
Site conditions
-
Warranties
-
Cancellation
-
Dispute resolution
If these website Terms conflict with a signed project agreement, the signed project agreement will control regarding that project.
Customer Responsibilities
Customers are responsible for providing complete and accurate information about the property and requested work. This may include property boundaries, surveys, easements, site plans, private utility information, septic-system locations, irrigation systems, underground structures, access restrictions, and known hazardous conditions.
Public underground utilities must be located before excavation begins. Customers must disclose private utilities and improvements that may not be included in a public utility locate.
Additional work or costs caused by inaccurate, incomplete, or undisclosed site information may require a written change order or revised agreement.
Scheduling and Delays
Any project duration or completion date discussed through the website is an estimate unless guaranteed in a signed agreement.
Work may be delayed or rescheduled because of weather, unsafe conditions, utility-location delays, permitting issues, material shortages, equipment problems, changes in scope, inaccessible work areas, emergencies, or events beyond our reasonable control.
Payments
Payment requirements, deposits, due dates, accepted payment methods, late charges, and other financial terms will be stated in the applicable estimate, invoice, or project agreement.
If electronic payment services are made available, they may be operated by third-party payment processors with separate terms and privacy practices.
Electronic Communications
When you submit information through the website or contact us electronically, you consent to receive responses related to your inquiry, quote, appointment, or project by email, telephone, or text message using the contact information you provide.
Your use of electronic communications does not require DJW Site Solutions to accept a project or conduct every transaction electronically.
Marketing text messages, if offered, require any consent mandated by applicable law. Marketing consent is not a condition of purchasing services. You may opt out of marketing text messages by replying STOP.

Any dispute relating solely to this website will be handled in an appropriate court with jurisdiction in Nebraska, unless applicable law or a separate signed agreement requires otherwise.
Severability
If any portion of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
No Waiver
Our failure to enforce any provision of these Terms does not waive our right to enforce that provision later.
